1. Acceptance of Terms
By accessing and using FishBid, you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use our platform.
2. User Accounts
Users must register an account to participate in auctions. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3. Seller Responsibilities
Sellers must:
- Provide accurate descriptions of fish listings
- Upload genuine photos of the actual fish being sold
- Deliver fish in the condition described
- Comply with all applicable laws and regulations
- Honor auction results and complete transactions
4. Buyer Responsibilities
Buyers must:
- Place bids in good faith with intention to purchase
- Complete payment if they win an auction
- Provide accurate shipping information
- Inspect fish upon delivery and report issues promptly
5. Auction Rules
All auctions are subject to the following rules:
- Bids must meet minimum increment requirements
- The highest bid at auction end wins
- Sellers cannot bid on their own listings
- Shill bidding is strictly prohibited
- FishBid reserves the right to cancel any auction
6. Payment Terms
Winning bidders must complete payment within 48 hours of auction end. Failure to pay may result in account suspension and banning from future auctions.
7. Fees and Commissions
FishBid charges a commission on successful sales. The commission rate is specified in our seller information. Listing fees may apply for premium features.
8. Shipping and Delivery
Shipping arrangements are made between buyer and seller. FishBid is not responsible for shipping delays or damages. Sellers must use appropriate packaging to ensure freshness.
9. Dispute Resolution
In case of disputes, FishBid will act as mediator. Decisions made by FishBid are final and binding. Users agree to cooperate in dispute resolution processes.
10. Prohibited Activities
The following activities are prohibited:
- Fraudulent listings or bids
- Selling illegal or endangered species
- Manipulating auction prices
- Using automated bidding tools
- Harassing other users
11. Intellectual Property
All content on FishBid, including text, images, and design, is protected by copyright. Users retain rights to their own content but grant FishBid a license to use it on the platform.
12. Limitation of Liability
FishBid is not liable for any losses, damages, or injuries resulting from use of the platform. We provide the platform "as is" without warranties of any kind.
13. Termination
FishBid reserves the right to suspend or terminate accounts that violate these terms. Users may also close their accounts at any time.
14. Changes to Terms
FishBid may modify these terms at any time. Continued use of the platform constitutes acceptance of updated terms.
15. Governing Law
These terms are governed by the laws of the jurisdiction where FishBid is registered. Any disputes will be resolved in the appropriate courts.
